PUBLIC OFFER AGREEMENT
The BilgenGroup limited liability partnership registered in the Turksib District Justice Department of the Department of Justice of Almaty, represented by Director Tursyn Ayan Khazretugli, acting on the basis of the Charter, hereinafter referred to as the 'Contractor', on the one hand and
for persons under the age of 18 - the legal representative of the minor (one of the parents or a person replacing them);
for persons over 18 years of age - an individual acting in their interests, hereinafter referred to as the 'Customer' on the other hand, hereinafter collectively referred to as the Parties, have concluded this Public Offer Agreement (hereinafter - the Agreement) as follows:

1. GENERAL PROVISIONS
1.1. Agreement in accordance with Art. 395 of the Civil Code of the Republic of Kazakhstan is a public offer, the complete and unconditional acceptance (acceptance) of the terms of which in accordance with Art. 396 of the Civil Code of the Republic of Kazakhstan is considered to be the implementation by the Customer of specific actions, namely, registration in the Personal Account located on the Contractor's Portal.
1.2. By taking actions to accept the Agreement, the Customer confirms his legal capacity and legal capacity, as well as his legal right to enter into contractual relations with the Contractor.
1.3. Acceptance of the Agreement means the consent of the Customer with all its provisions and is equivalent to the conclusion of the Agreement in writing.
1.4. In connection with the foregoing, carefully read the text of the Agreement. If you do not agree with any clause of the Agreement, the Contractor offers you to refuse the acceptance of the offer and conclude a contract with the Contractor in writing.
2. SUBJECT OF THE AGREEMENT
2.1. Under the Agreement, the Contractor shall provide the Customer with the services provided on the Portal https://bilgen.academy/ (hereinafter referred to as the Portal), and the Customer shall pay for these services in the amount, manner and terms stipulated by the Agreement.
2.2. Language for the provision of services: Russian, Kazakh, English.
2.3. The procedure for the provision of services, the rights and obligations of the Parties, as well as other conditions for the provision of services are posted on the Portal in the appropriate section.
3. RIGHTS AND OBLIGATIONS OF THE CONTRACTOR
3.1. The Contractor is obliged:
3.1.1. Provide services of appropriate quality.
3.2. The Contractor has the right:
3.2.1. To amend the Rules, Regulations and other documents relating to the provision of services with prior notification at least 10 (ten) days before the entry into force of such changes on the Portal and in the Customer’s Personal Account.
4. RIGHTS AND OBLIGATIONS OF THE CUSTOMER
4.1. The customer must:
4.1.1. Make payment for the services of the Contractor in the manner, amount and terms established by the Agreement.
4.1.2. Read the Rules, Regulations and other documents posted on the Portal regarding the provision of services.
4.2. The customer has the right:
4.2.1. Refuse to receive a particular service in accordance with the Rules, Regulations and other documents relating to such a service.
5. COST AND ORDER OF PAYMENT FOR SERVICES
5.1. The cost of services, the procedure and terms of payment are indicated on the Portal, in the appropriate section.
5.2. All payments under the Agreement are made in tenge by bank transfer at the details specified on the Portal in the corresponding section.
6. RESPONSIBILITY OF THE PARTIES
6.1. General issues of responsibility of the Parties for failure to fulfill their obligations are regulated by the current legislation of the Republic of Kazakhstan.
6.2. All disputes and disagreements arising between the Parties under the Agreement or in connection with it are resolved through negotiations. If it is impossible to resolve the dispute arising between the Parties in pre-trial procedure, the dispute shall be settled in court, in accordance with the current legislation of the Republic of Kazakhstan.
6.3. The Parties shall be exempted from liability for partial or full failure to fulfill obligations under the Agreement if this failure or improper performance was the result of force majeure circumstances arising as a result of extraordinary circumstances that the Parties could not foresee or prevent.
7. OTHER CONDITIONS
7.1. The Agreement shall enter into force upon acceptance of the terms by the Customer (Acceptance) in the manner prescribed by the Agreement - from the moment of registration of the Customer in the Personal Account on the Portal, and concluded for an indefinite period.
7.2. By concluding the Agreement, the Customer agrees to the collection, processing and use of personal data of the Customer (the minor submitted by him), such as Surname, name, middle name, gender, date of birth, school number and name, class, results of service, and consent to that the data specified in this clause can be posted on the Contractor's websites in the lists of winners, prize winners, students, graduates, distinguished themselves, etc.
7.3. The contract is drawn up in Kazakh and Russian. In case of discrepancies or any discrepancies in the terms, the text of the Agreement drawn up in Russian will have an advantage.
7.4. The Contractor has the right to unilaterally change the terms of the Agreement and its annexes. The Contractor shall notify the Customer about the introduced changes by publishing a message about the changes, the changes themselves and / or new documents on the Portal and / or through the Personal Account.
7.5. In case of disagreement of the Customer with the introduced changes, the latter has the right to immediately terminate the Agreement by notifying the Contractor in writing or through the Personal Account. If the Contractor does not have a notice of termination of the Agreement for the above reasons within 10 (ten) calendar days from the date of publication of the notice of changes, these changes are considered accepted by the Customer.
7.6. The contract may be terminated at any time by agreement of the Parties.
